The agreement between you and Gemini Trade.
Who these terms bind
These terms apply between you and Gemini Trade from the moment you open an account or use any part of the platform. If you are using the platform on behalf of a company, you confirm you are authorised to bind it.
You must be at least 18 and legally able to enter a contract. You must not use the platform from a jurisdiction where doing so would breach local law, and you are responsible for knowing whether that is the case where you live.
We may update these terms. Material changes are announced on the site before they take effect; continuing to use the platform after that date is how you accept them.
What the service is
Gemini Trade is an automated trading platform. You fund an account, and an engine runs cross-exchange arbitrage sessions against that balance on your behalf. You do not place orders, choose strategies, or set parameters.
We are a technology provider. We are not a bank, a broker-dealer, an exchange, a custodian in the regulated sense, or an investment adviser. Nothing on this site is financial, tax or legal advice, and no relationship of trust or advice arises from your use of it.
The engine's behaviour is governed by the limits published on the platform: a lifetime earning potential and a daily budget, both derived from what you have deposited, and a fixed pause between sessions. These are part of the service, not a restriction imposed on your account individually.
Your account
One person, one account. You are responsible for your credentials, for enabling two-factor authentication before withdrawing, and for everything done through your account by anyone who obtains access to it.
You must give accurate information when you register and keep it current. We may ask you to verify your identity where our AML and KYC policy calls for it, and we may hold activity on the account until you do.
You may close your account at any time by withdrawing your balance and asking support to close it. We may suspend or close an account for breach of these terms, for suspected financial crime, or where continuing to serve it would expose us to legal risk.
Deposits, profit and withdrawals
Deposits credit once the network confirms them. The minimum is $100. Funds sent on the wrong network, or to an address that was not issued to you, may be unrecoverable.
Profit is credited to your balance as individual trades settle during a session. Balances shown on the platform reflect our records; where our records and your expectations differ, our records govern unless you show them to be wrong.
Withdrawals are paid to an address you supply and are subject to the conditions in our Withdrawal Policy, including two-factor authentication and review. You are responsible for the accuracy of the address; transfers on a public blockchain cannot be reversed.
Liability
The platform is provided as it is. We do not warrant uninterrupted operation, and we do not promise any level of profit — figures published anywhere on the site describe configuration and past sessions, never a guaranteed outcome.
To the extent the law allows, we are not liable for indirect or consequential loss, for loss of profit or opportunity, or for losses caused by circumstances outside our control, including network congestion, exchange outages and force majeure.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.
Governing terms
If any clause is found unenforceable, the rest continues to apply. Our failure to enforce a right on one occasion is not a waiver of it.
